Right to Appeal

HAZLOC International Institute of Training is committed to maintaining a fair and transparent certification process. As a candidate, you have the right to appeal any decision made by HAZLOC International Institute of Training regarding your certification. Below are the terms and conditions that outline your right to appeal and the basic steps involved in the appeal process.

 

Right to Appeal
  • Eligibility to Appeal: If you disagree with a decision made by HAZLOC International Institute of Training regarding your examination results, certification status, or any other aspect of the certification process, you have the right to appeal.
  • Grounds for Appeal: Appeals can be made on various grounds, including but not limited to perceived errors in the examination process, disagreement with the outcome, or issues related to the fairness of the process.
Submitting an Appeal
  • Timeframe for Appeal: Appeals must be submitted in writing within 30 days of receiving the decision that you wish to appeal.
  • How to Submit: To submit an appeal, you must provide a written statement detailing the reasons for your appeal, including any relevant evidence or documentation. Appeals should be directed to the official contact provided by HAZLOC International Institute of Training on our website or through direct communication channels.
Basic Steps in the Appeal Process
  • Acknowledgment of Appeal: Upon receiving your appeal, HAZLOC International Institute of Training will acknowledge receipt of your appeal within five business days. You will be informed that your appeal is being reviewed and provided with an estimated timeframe for a decision.
  • Review Process: Your appeal will be reviewed by an independent Appeals Committee, which consists of individuals who were not involved in the original decision-making process. The committee will evaluate the information provided in your appeal, as well as any additional relevant documentation.
  • Decision on Appeal: The Appeals Committee will make a decision based on their review. You will be notified of the outcome in writing within 30 days of the appeal submission. The decision will include a clear explanation of the reasons behind the decision.
  • Further Action: If you are not satisfied with the outcome of the appeal, you may request a further review or escalate the appeal to an external body as per the guidelines provided by HAZLOC International Institute of Training.
Final Decision
  • Finality of Decision: The decision made by the Appeals Committee is considered final unless further action is taken as outlined above. If no further action is requested within the specified timeframe, the decision will be considered resolved.
Confidentiality
  • Confidential Handling: All information related to your appeal will be handled with the utmost confidentiality. Only those directly involved in the review and decision-making process will have access to your appeal documents.
Non-Retaliation
  • No Negative Consequences: Exercising your right to appeal will not result in any negative consequences regarding your current or future certification opportunities with HAZLOC International Institute of Training.

HAZLOC International Institute of Training is dedicated to providing a transparent and fair certification process. Suppose you have a formal complaint regarding any aspect of our services, examinations, or certification process. In that case, we encourage you to bring it to our attention so that we can address your concerns promptly and effectively.

 

What Constitutes a Formal Complaint

Definition: A formal complaint is any expression of dissatisfaction with the services, processes, or outcomes provided by HAZLOC International Institute of Training. This includes complaints related to the conduct of our staff, examination procedures, certification decisions, or the quality of training provided.

How to Submit a Formal Complaint
  • Written Submission: Complaints must be submitted in writing to ensure that all concerns are clearly documented. Your complaint should include your full name, contact information, details of the issue, and any supporting evidence.
  • Submission Methods: Complaints can be submitted via email, postal mail, or through our online contact form available on the HAZLOC International Institute of Training. Please use the contact details provided on our website for submission.
Complaint Handling Process
  • Acknowledgment of Receipt: Upon receiving your formal complaint, HAZLOC International Institute of Training will acknowledge receipt within five business days. This acknowledgment will include confirmation that your complaint is being reviewed and an estimated timeframe for resolution.
  • Investigation and Review: Your complaint will be thoroughly investigated by an independent review team within HAZLOC International Institute of Training. This team will gather all relevant information, interview involved parties, and assess the validity of the complaint.
  • Resolution and Response: After the investigation, we will provide you with a written response detailing the outcome of the review. This response will include any actions that have been or will be taken to address the complaint and, if applicable, how similar issues will be prevented in the future. The resolution will be communicated to you within 30 days of receiving the complaint.
Escalation of Complaints

If you’re not satisfied with how your complaint has been handled, you can ask for it to be reviewed by a higher authority within HAZLOC International Institute of Training Pty Ltd.

If you still feel the matter hasn’t been resolved fairly, you also have the right to raise your concern with an external body in line with IECEx 01S – such as the IECEx Secretariat.

Should the issue remain unresolved after this stage, a formal appeal can be made in accordance with IEC CA 01.

Confidentiality and Non-Retaliation
  • Confidential Handling: All formal complaints are handled with strict confidentiality. Only those directly involved in the investigation and resolution of the complaint will have access to the complaint details.
  • No Retaliation: Submitting a formal complaint will not result in any form of retaliation or negative consequences regarding your current or future dealings with HAZLOC International Institute of Training. Jurisdiction

HAZLOC International Institute of Training is an Australian company. By accepting this quote or enrolling in any course provided by HAZLOC International Institute of Training, you consent to any disputes arising from this agreement being governed by and construed in accordance with the laws of Australia. You further agree that any such disputes will be subject to the exclusive jurisdiction of the courts of Australia.

Refund Policy

Our refund policy is governed by Australian law, ensuring fairness and transparency in all transactions. Customers are entitled to guarantees under Australian Consumer Law, which protects your rights in the event of issues such as faulty services or changes to course availability. If you believe you are eligible for a refund, please contact us directly to discuss your situation.

Applicants who require special accommodations are encouraged to declare their needs as early as possible. Requests should be made in writing and submitted to HAZLOC International Institute of Training Pty Ltd at the time of enrolment or as soon as the need for accommodation is identified.

Information Required: The request should include:

Student Commitment Declaration

Enrollment in a course with HAZLOC International Institute of Training Pty Ltd signifies that all information provided in the enrolment form is accurate and truthful to the best of the student’s knowledge. Additional information may be requested by HAZLOC International Institute of Training Pty Ltd to verify the details provided during the enrolment process.

Students are required to promptly inform HAZLOC International Institute of Training Pty Ltd of any changes that could affect their ability to meet certification requirements. This includes, but is not limited to, changes in employment status, health conditions, or other circumstances that may impact their capability to maintain certification standards.

A clear understanding of the requirements for the IECEx Certificate of Personnel Competence is expected of all candidates. Upon acceptance into the certification process, students commit to meeting all outlined requirements. Compliance with the IECEx Certification of Personnel Competence Scheme, accurate representation of certification scope, and payment of associated expenses are also part of this commitment.

It is declared that:

  • All information submitted with the application is accurate and correct.
  • No other application is currently pending with another ExCB.

Examination materials, including questions, answers, scenarios, and other related content, are considered confidential and proprietary to HAZLOC International Institute of Training Pty Ltd. Students commit to maintaining the confidentiality of these materials and to refraining from unauthorised sharing, reproduction, or discussion.

Integrity and honesty are essential in the examination process. Students are committed to avoiding any fraudulent behaviour, such as cheating, using unauthorised aids, or assisting others in such actions. Information regarding examination procedures, formats, or content is not to be disclosed to unauthorised parties.

Any breach of this commitment or the Non-Disclosure Declaration may result in termination from the certification process, invalidation of certifications, and potential legal action by HAZLOC International Institute of Training Pty Ltd.

All enrolments and associated agreements are governed by Australian law. Any disputes arising from these agreements will be subject to the exclusive jurisdiction of Australian courts.

Training and Examinations

In line with our impartiality and separation requirements, candidates who have completed hazardous area training with HAZLOC within the past two (2) years may not be eligible to undertake certification examinations with HAZLOC International Institute of Training Pty Ltd. This separation ensures fairness, independence, and compliance with IECEx impartiality principles.

Privacy and Confidentiality

All data collected by HAZLOC International Institute of Training Pty Ltd is treated as strictly confidential and is protected under the Australian Privacy Act 1988. This means any personal information, academic records, or other data provided by candidates will only be used for purposes directly related to their training, assessment and certification. Access to this data is restricted to authorised personnel and will not be shared with third parties (other than those directly involved in the IECEx CoPC process) without the explicit consent of the student, unless required by law. The institute is committed to maintaining the highest standards of data security and privacy, ensuring that all information is stored securely and managed in compliance with Australian privacy legislation.

Transactions and Refunds

All training and certification transactions conducted through the Hazloc Training website are deemed to take place in Australia, regardless of where the training or assessment is delivered. By enrolling in any course or certification process, you acknowledge that:

  • The transaction is governed by Australian law.

  • You are entitled to refunds and remedies only as stipulated under the Australian Consumer Law (ACL).

  • No additional or international refund rights apply beyond those required under Australian law.

Use of Logos and Trademarks

Candidates must only use the IECEx logo in accordance with the approved IECEx Operational Documents and guidelines available at www.iecex.com.

The HAZLOC International Institute of Training Pty Ltd name and logo are protected trademarks. Candidates, training providers, and third parties are not permitted to use the HAZLOC name, logo, or any derivative branding for promotional, marketing, or professional purposes without prior written authorisation from the Managing Director of HAZLOC Training. Any unauthorised use may result in disciplinary action, revocation of certification, or legal proceedings. Any misuse of the IECEx or HAZLOC logos, including unauthorised reproduction, modification, or misleading association, is strictly prohibited. HAZLOC reserves the right to take corrective or legal action where misuse is identified, including notifying the IECEx Secretariat or other relevant authorities. Misuse may result in the withdrawal of certification, suspension from assessment activities, or further disciplinary measures.

Use of IECEx Certificates

Candidates who have been issued an IECEx Certificate of Personnel Competence (CoPC) are permitted to use and display their certificate only in its complete and unaltered form as published by the IECEx Secretariat. The certificate may be presented to employers, clients, and regulators as evidence of competence.

Certificates must not be modified, reproduced, or used in a misleading manner, and any references to IECEx certification must clearly state the scope and units of competence awarded. The IECEx logo may only be used as it appears on the official certificate and must not be applied to company marketing materials, business cards, or promotional content.
